Rochester, NY -- A judge has ruled a Rochester man's suit against the city's red light cameras can be heard in court.
Lawrence Krieger claims the red light cameras violate the constitutional right to due process.
The city asked that the suit be dismissed on grounds that Krieger should use the city's appeals process if he feels the red light ticket was wrong.
Krieger's Attorney says the judge rejected that argument.
Attorney Michael Steinberg says they will argue the case in State Supreme Court on September 11th. Steinberg says they're arguing the city's 31 red light camera interesections are unconstitutional because people who get ticketed by the cameras never get to confront their accuser.
