Rochester N.Y. -Sentencing is set for this afternoon (at 2 p.m.) for Mark Scerbo, the Penfield man convicted in the crash last July that killed a Fairport teacher on her bicycle.
A jury last month found Scerbo guilty of manslaughter, aggravated DWI, and reckless driving. He was found not guilty of aggravated vehicular homicide.
Scerbo stood trial alongside Megan Merkel. Prosecutors said Merkel's car hit Heather Boyum, after Scerbo crashed his motorcycle into Boyum's bicycle. A separate jury found Merkel not guilty of manslaughter and vehicular manslaughter and guilty of less serious charges.
