An off-duty State Trooper has been charged with DWI after an accident in the Town of Gates.

State Police say the crash happened on February 28^th on I-490.  They say that 30 year old Martin McClellan of Rochester suffered a broken leg in the one-car crash.  They say his blood alcohol level was .18, which is more than twice the legal limit.

McClellan was charged with aggravated DWI and he is now on extended sick leave due to his injuries.
