(13-WHAM) John Horace, the man convicted of raping and impregnating a comatose nursing home patient in Brighton some years ago, has been deemed a Level-2 sex offender.

A judge ruled Friday that Horace will have to register his photograph and residence on the state's sex offender registry.

Horace is scheduled to be released from prison in March however Horace could still be confined if the Department of Mental Health determines he is dangerous enough for civil confinement.

His victim, known as Kathy, died a year after giving birth to a son. DNA evidence linked Horace to the sexual assault inside a Brighton nursing home in 1995.
