Anthony Love was arrested in July 2020 for the death of Kei'mere Marshall.
The boy's mother, Andrea Lipton, will face a separate trial for not getting help for the boy after the beating.
The boy was found not breathing at an address on Avenue C, and died three days after being placed on life support.
At the time, Love was already on parole from a 2016 robbery conviction.
